1. Introduction

Welcome to F&J Poultry CC. These Terms of Service ("Terms") govern your access to and use of our website, products, and services. By accessing or using our services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our services.

3. Products and Services

F&J Poultry manufactures and provides:

• Steel structures and feed storage silos

• Installation and after-sales support services

All products are subject to availability. We reserve the right to modify product specifications and discontinue products without prior notice.

4. Quotations and Orders

4.1 Quotations

All quotations provided are valid for 30 days from the date of issue unless otherwise stated. Prices are subject to change based on material costs, currency fluctuations, and other market factors.

4.2 Order Acceptance

A binding contract is formed only when we accept your order in writing. We reserve the right to refuse any order for any reason, including but not limited to product availability, errors in pricing, or credit approval.

4.3 Deposits

A deposit of 50% is typically required upon order confirmation. The balance is payable upon completion of installation or delivery, unless alternative payment terms have been agreed in writing.

5. Pricing and Payment

5.1 Pricing

All prices are quoted in South African Rand (ZAR) and exclude VAT unless otherwise stated. Delivery and installation costs are quoted separately.

5.2 Payment Terms

Payment terms are net 30 days from invoice date unless otherwise agreed. Late payments may incur interest charges at the rate of 2% per month (compounded monthly).

5.3 Payment Methods

We accept payment via electronic funds transfer (EFT), bank deposit, or other methods as agreed upon. Credit card payments may be subject to additional fees.

6. Delivery and Installation

6.1 Delivery Timeframes

Estimated delivery and installation timeframes are provided in good faith but are not guaranteed. We are not liable for delays caused by circumstances beyond our reasonable control, including but not limited to material shortages, weather conditions, or force majeure events.

6.2 Site Preparation

The customer is responsible for ensuring the site is properly prepared and accessible for delivery and installation. Any additional work required due to inadequate site preparation will be charged separately.

6.3 Risk and Title

Risk in the goods passes to the customer upon delivery. Title remains with F&J Poultry until full payment has been received.

7. Warranties and Guarantees

7.1 Product Warranty

We warrant that our products are free from defects in materials and workmanship for a period of 12 months from the date of installation, subject to normal use and proper maintenance.

7.2 Installation Warranty

We guarantee our installation work for a period of 12 months from the completion date, provided the equipment has been used and maintained according to our specifications.

7.3 Warranty Exclusions

Our warranty does not cover:

• Normal wear and tear
• Damage caused by misuse, negligence, or accidents
• Modifications or repairs by unauthorized parties
• Failure to follow maintenance recommendations
• Acts of God, natural disasters, or force majeure events

8. Returns and Cancellations

8.1 Custom Orders

Due to the custom nature of our products, cancellations after production has commenced may result in charges for materials and labor already incurred.

8.2 Defective Products

If products are found to be defective within the warranty period, we will repair or replace them at no charge, provided the defect is covered under our warranty terms.

9. Limitation of Liability

To the maximum extent permitted by South African law:

• F&J Poultry's total liability shall not exceed the value of the specific order giving rise to the claim
• We are not liable for indirect, consequential, or punitive damages
• We are not liable for loss of profits, revenue, or business opportunities
• We are not liable for damages arising from delays in delivery or installation

10. Intellectual Property

All designs, specifications, and technical documentation remain the intellectual property of F&J Poultry. Customers may not reproduce, modify, or distribute our designs without prior written consent.

11. Website Use

11.1 Permitted Use

You may use our website for lawful purposes related to inquiring about or purchasing our products and services.

11.2 Prohibited Activities

You may not:

• Use our website for any illegal or unauthorized purpose
• Attempt to gain unauthorized access to our systems
• Interfere with the proper functioning of our website
• Transmit viruses, malware, or other harmful code
• Scrape, harvest, or collect information about other users

12. Privacy and Data Protection

14. Force Majeure

We are not liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, strikes, pandemics, government restrictions, or material shortages.

15. Amendments

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services after changes constitutes acceptance of the modified Terms.

16. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

17. Entire Agreement

These Terms, together with any written quotations or agreements, constitute the entire agreement between you and F&J Poultry and supersede all prior understandings and agreements.
